1. Acceptance of Terms
By accessing or using DataFaux ("Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.
These Terms apply to all users of the Service, including anonymous users, free tier users, and paid subscribers.
These Terms are governed by the laws of England and Wales, United Kingdom. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
2. Description of Service
DataFaux provides a synthetic test data generation platform designed for professional use in development, testing, quality assurance, demonstrations, and other legitimate business purposes. The Service includes:
- Web-based data generation interface
- RESTful API for programmatic access (for registered users)
- Schema management and storage
- Data export in multiple formats (JSON, CSV, SQL, etc.)
- Usage tracking and analytics
- Freemium access model with guest, free, and premium tiers
Important Notice About Generated Data:
- All data generated by DataFaux is synthetic and algorithmically created using internal libraries
- Generated data does not contain or derive from real personal information
- Any resemblance to real persons, businesses, addresses, phone numbers, or other entities is purely coincidental and unintentional
- DataFaux is designed for test data purposes only and should not be used to create data intended to represent real individuals or entities
3. User Accounts and Access Tiers
3.1 Anonymous/Guest Access
You may use DataFaux without creating an account in guest mode with limited functionality and usage limits.
3.2 Account Creation
To access enhanced features and increased limits, you may create a free account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
- Not share your account credentials with others
- Be at least 16 years of age
3.3 Account Termination
We reserve the right to suspend or terminate accounts that:
- Violate these Terms of Service
- Engage in fraudulent, abusive, or illegal activities
- Use the Service for malicious purposes
- Attempt to circumvent usage limits or security measures
- Harm other users or the Service itself
4. Acceptable Use Policy
DataFaux is intended exclusively for legitimate professional purposes including software development, testing, quality assurance, demonstrations, training, and similar lawful activities.
4.1 Prohibited Uses
You expressly agree NOT to use the Service to:
- Illegal Activities: Generate data for fraud, identity theft, money laundering, or any illegal purpose
- Malicious Intent: Create data intended to harm, deceive, or defraud any person, business, or entity
- Impersonation: Generate data with the intent to impersonate real individuals or entities
- Spam or Phishing: Create datasets for spam campaigns, phishing attacks, or unsolicited communications
- Data Scraping: Use generated data to populate fake profiles, reviews, or misleading content
- Circumvention: Attempt to bypass rate limits, security measures, or usage restrictions
- Reverse Engineering: Attempt to reverse engineer, decompile, or extract source code from the Service
- Unauthorized Resale: Resell, redistribute, or sublicense the Service without authorization
- System Abuse: Overload, attack, or compromise the Service infrastructure
- Legal Violations: Violate any applicable laws, regulations, or third-party rights
4.2 Professional Use Requirement
By using DataFaux, you represent and warrant that you are using the Service solely for legitimate professional purposes and not for any malicious, fraudulent, or harmful activities. Violation of this requirement may result in immediate account termination and potential legal action.
5. Freemium Model and Billing
5.1 Anonymous/Guest Tier
Anonymous access is provided at no cost with basic functionality and minimal usage limits. No account required.
5.2 Free Tier
The free tier is provided at no cost with increased usage limits compared to anonymous access. Requires account registration. Limitations are specified on our pricing page.
5.3 Premium/Paid Subscriptions
Paid subscriptions provide significantly increased limits and additional features. Subscriptions are billed monthly or annually in advance. By subscribing, you authorize us to charge your designated payment method.
- Prices are displayed in GBP (£) and may be subject to VAT where applicable
- Payment is processed through secure third-party payment processors
- Subscriptions automatically renew unless cancelled
- Price changes will be communicated at least 30 days in advance
5.4 Refunds
We offer a 30-day money-back guarantee for new Premium subscriptions. Contact support within 30 days of your initial purchase for a full refund. Refunds for subsequent renewals are at our discretion.
5.5 Cancellation
You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. You will retain access to premium features until the end of the paid period.
5.6 Failed Payments
If a payment fails, we will attempt to process it again. Continued payment failures may result in downgrade to the free tier or account suspension.
6. Usage Limits
Each access tier has specific usage limits as detailed on our pricing page. Typical limits include:
- Anonymous/Guest: Limited rows per generation, no API access, no schema saving
- Free Tier: Increased generation limits, limited API access, limited schema storage
- Premium/Paid: Significantly higher limits, full API access, unlimited schema storage
- Enterprise: Custom limits based on individual agreement
Specific limits are subject to change and will be clearly displayed on the pricing page and in your account dashboard.
Exceeding limits may result in request throttling, temporary rate limiting, or service suspension. Upgrade your plan to increase limits. Systematic abuse of limits may result in account termination.
7. Intellectual Property
7.1 Our Rights
Datafaux and its original content, features, and functionality are owned by us and protected by international copyright, trademark, and other intellectual property laws.
7.2 Your Rights
You retain all rights to the data you generate using our Service. The generated data is yours to use as you see fit, subject to these Terms.
7.3 Schemas
Schemas you create are your intellectual property. We store them to provide the Service but do not claim ownership.
8. Data and Privacy
Our collection and use of personal information is described in our Privacy Policy.
Generated data is synthetic and does not contain real personal information. We do not store generated data on our servers beyond temporary caching.
9. Disclaimers and Limitations
9.1 Service Availability
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee uninterrupted, timely, secure, or error-free operation. We may suspend or discontinue the Service for maintenance, updates, or other reasons with or without notice.
9.2 Limitation of Liability
To the maximum extent permitted by applicable law, DataFaux and its officers, directors, employees, and agents shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions or data loss
- Damages arising from your use or inability to use the Service
- Any damages exceeding the amount you paid to DataFaux in the 12 months preceding the claim
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
9.3 Synthetic Data Disclaimer
Important Disclaimer:
- All data generated by DataFaux is synthetic and algorithmically created
- We make no guarantees about the accuracy, realism, completeness, or suitability of generated data for any particular purpose
- Any resemblance to real persons, businesses, or entities is purely coincidental and unintentional
- You are solely responsible for how you use generated data
- DataFaux is not liable for any consequences arising from your use of generated data
- Generated data should only be used for testing, development, and other legitimate professional purposes
10. Indemnification
You agree to indemnify and hold harmless Datafaux from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales, United Kingdom, without regard to conflict of law principles.
Any disputes, claims, or controversies arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. However, we retain the right to bring proceedings in the courts of your country of residence if you breach these Terms.
13. Dispute Resolution

If informal resolution is unsuccessful, disputes shall be resolved through the courts of England and Wales as specified in Section 12, subject to applicable consumer protection laws in your jurisdiction.
Nothing in these Terms affects your statutory rights as a consumer under applicable law.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision shall be modified to reflect the parties' intention or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and DataFaux concerning the Service and supersede all prior agreements and understandings.
